By accessing or using Web2Phone (the “Service”), you agree to these Terms and Conditions. If you don’t agree, please do not use the Service.

1. Agreement to Terms

Using the Service means you agree to be bound by these Terms. If you disagree with any part, you may not access the Service.

2. Description of Service

Web2Phone provides a SaaS contact-form backend that forwards submissions from your website to WhatsApp and email, with a form management dashboard and analytics. Email delivery uses your configured SMTP (e.g. IONOS).

3. Account Registration

3.1 Eligibility

You must be at least 18 and able to form a binding contract.

3.2 Account Security

  • Keep your credentials confidential.
  • Notify us immediately of any unauthorized access.
  • You’re responsible for all activity under your account.

3.3 Accurate Information

Provide accurate, current information and keep it updated.

4. Subscription Plans & Pricing

4.1 Available Plans

  • Free: £0 — 25 emails, 3 WhatsApp, 1 form
  • Email-Only: £4.99 — 1,000 emails, 0 WhatsApp, 3 forms
  • Starter: £7.99 — Unlimited emails, 100 WhatsApp, 5 forms
  • Pro: £14.99 — Unlimited emails, 300 WhatsApp, 10 forms
  • Business: £34.99 — Unlimited emails, 1,000 WhatsApp, 25 forms

Plan features and prices are as stated in the Terms and may change with notice.

4.2 Payment Terms

  • Billed monthly in advance; all fees in GBP.
  • Prices may change with 30 days’ notice.
  • No refunds for partial months/unused services.

4.3 Automatic Renewal

Paid subscriptions renew automatically unless cancelled before the renewal date.

5. Acceptable Use Policy

You must not use the Service for illegal activity, spam, unauthorized access attempts, interference, harassment, IP infringement, or distribution of malware.

6. Service Availability & Limitations

6.1 Uptime

We strive for 99.9% uptime but do not guarantee uninterrupted service; scheduled maintenance may occur.

6.2 Usage Limits

Usage is limited by your plan. If you exceed limits, we may pause service until the next cycle, apply an automatic upgrade (with notice), or charge overages.

6.3 WhatsApp Backup

If WhatsApp delivery fails, messages will be sent via email as a backup.

7. Data & Content

7.1 Your Data

You retain rights to your form data; we process it only to provide the Service.

7.2 Our Rights

We may review content for compliance with these Terms and applicable laws.

7.3 Data Retention

Form data is retained for 90 days. You can request deletion at any time.

8. Intellectual Property

The Service (software, designs, trademarks) is owned by Web2Phone and protected by IP laws; you get a limited, non-exclusive license to use it.

9. Termination

9.1 By You

Cancel anytime from your dashboard; cancellation takes effect at the end of the billing period.

9.2 By Us

We may suspend/terminate for Terms violations, fraud, non-payment, or harmful use.

9.3 Effect

Access stops on termination; data deleted after 30 days; no refunds for unused time.

10. Disclaimers & Limitations

10.1 “As Is”

The Service is provided “as is” without warranties.

10.2 Liability Cap

To the maximum extent permitted by law, we’re not liable for indirect or consequential damages, or amounts exceeding what you paid in the 12 months before the claim.

10.3 Third-Party Services

We aren’t responsible for failures of third-party services (e.g., WhatsApp, email, payments).

11. Indemnification

You agree to indemnify and hold Web2Phone harmless from claims arising from your use of the Service or violation of these Terms.

12. Modifications to Terms

We may modify these Terms; material changes will be notified via email or in-product. Continued use means acceptance.

13. Governing Law & Disputes

These Terms are governed by the laws of England & Wales. Disputes are resolved via binding arbitration in the UK, except where prohibited by law.

14. General Provisions

  • Entire Agreement: These Terms are the full agreement between you and Web2Phone.
  • Severability: If one provision is unenforceable, the rest remain in effect.
  • No Waiver: Failure to enforce a right isn’t a waiver.
  • Assignment: You may not assign these Terms without our consent; we may assign our rights/obligations.
